Marriage for the second time in the UAE can have more than one legal meaning. A person may be divorced and wish to remarry, widowed after the death of their spouse, or a married Muslim man who wishes to take a second wife while remaining married to his first wife.
These cases are not subject to the same rules.
For Muslims, Federal Decree-Law No. (41) of 2024 on Personal Status regulates marriage, polygamy, and the rights arising from a marriage contract. Civil marriage, however, is governed by a different system, with conditions related to marital status and the existence of a valid marriage, which vary depending on the legal system and the competent court.
Therefore, before starting the procedures for a second marriage in the UAE , it must first be determined whether the situation is a new marriage after the end of the previous marriage, or polygamy while the first marriage is still ongoing.
Is a second marriage legal in the UAE?
Yes, a second marriage can be legal in the UAE, but the conditions vary depending on the religion of the parties, their social status, and the legal system that will apply to the marriage.
There are three main cases:
| the condition | General situation |
| Muslim divorced or widowed | He can marry again after fulfilling the conditions of marriage, taking into account the waiting period for the woman. |
| A Muslim man who is still married | He can marry more than one wife within the limits and conditions stipulated in the Personal Status Law. |
| civil marriage | The applicable civil system and the social status of each party must be reviewed, because the existence of an existing marriage may prevent the completion of the new marriage. |
If you are unsure which system applies to your case, you can consult marriage services in Dubai and the UAE to determine the appropriate course of action before submitting a marriage application.
Is it permissible for a Muslim man to marry a second wife in the UAE?
Yes.
The UAE Personal Status Law permits a Muslim man to have multiple wives within the legal and religious limits.
Article 32 of the Personal Status Law stipulates that a man may not have more than four wives at the same time, meaning that a Muslim man can be married to up to four wives at the same time, provided that the marriages meet the legal requirements.
Other impediments to marriage must also be taken into account. For example, it is not permissible to marry at the same time two women who are related in a manner that the law prohibits, such as two sisters or a woman and her aunt or maternal aunt.
Does marrying a second wife require the consent of the first wife?
The current Personal Status Law does not establish a general rule requiring the consent of the first wife in order for a Muslim man to marry another wife.
Therefore, the mere lack of consent of the first wife does not automatically invalidate the second marriage contract if the marriage meets its legal requirements.
However, the terms of the first marriage contract must be checked .
Article 33 of the Personal Status Law allows for the inclusion of valid conditions in the marriage contract, and these conditions are binding as long as they do not violate the original contract or the provisions of Sharia and the law.
If one spouse violates a valid and written condition in the marriage contract, the other party may have legal rights that vary according to the nature of the condition and the circumstances.
Therefore, before remarrying, it is helpful to review the existing marriage contract and not just ask whether the first wife’s consent is required or not.
Does a man need special permission from the court to get married a second time?
There is no general rule in the current Personal Status Law that requires a Muslim man to obtain separate permission from the court simply because he wishes to marry a second wife.
However, the new marriage contract itself must meet the conditions of marriage and be documented through the judicial authority or the authorized marriage officiant in accordance with the procedures in place.
Additional requirements may also arise related to the nationality, age, marital status, or documents issued from outside the country of one of the parties.
Therefore, a distinction must be made between documenting a marriage in court and obtaining “permission for polygamy”; they are not the same thing.
What are the husband’s obligations if he has more than one wife?
Polygamy does not negate legal obligations towards any wife.
The Personal Status Law stipulates that the husband is obligated to treat his wives justly in:
- The transaction.
- The division and allocation of time.
- Obligatory expenses.
Each wife also has the right to maintenance according to legal provisions, provided that the conditions for her entitlement are met.
A second marriage may not result in the forfeiture of the rights of the first wife or the children resulting from the first marriage.
Should a separate house be provided for each wife?
Not every wife necessarily has to be in a different building.
The Personal Status Law regulates the issue of having more than one wife in a more specific way.
A husband may house more than one wife in the same building if:
- The accommodation was suitable.
- Each wife had a near-complete degree of independence within the dwelling.
- Suitable health and service facilities were provided.
- There was adequate separation at the entrances and exits.
If the housing arrangement causes harm to one of the wives, the court can impose additional conditions at the request of the affected wife.
Therefore, the rule is not simply “each wife must have a separate house,” but rather that suitable housing, independence, and non-infringement of the wife’s rights must be ensured.
What are the conditions for a second marriage contract for Muslims?
The second marriage of a Muslim man is subject, in principle, to the same conditions for the validity of a legal marriage contract that apply to the first marriage.
The most important requirements include:
- Clearly identify the couple.
- There is no legal or religious impediment to marriage.
- The wife’s consent to the marriage.
- The presence of a guardian when required by law.
- Valid offer and acceptance.
- The presence of two witnesses who meet the requirements.
- Meeting the legal age requirements.
- Pre-marital medical examination.
- Officially documenting the marriage contract.

Summary
Second marriage in the UAE is legally possible, but the answer depends first on what is meant by “second marriage” in the same case.
A Muslim man who is still married can, within the legal and religious provisions, marry another wife, provided that the number does not exceed four wives, while adhering to justice in treatment, division, and obligatory maintenance.
As for a divorced or widowed woman who wishes to remarry, the previous marriage must have legally ended and the waiting period (iddah) must be completed when required, with the submission of documents proving the marital status.
In civil marriage, there are different rules regarding the existence of a marital relationship and disclosure of a previous marriage, so the rules of legal polygamy should not be automatically applied to civil marriage.
Before submitting a marriage application, it is best to determine which legal system applies to both parties and review the previous marriage contract, marital status, waiting period, and required documents so that the new marriage is properly documented.
